These Terms and Conditions apply to your use of the PaardPlaats service. PaardPlaats is a platform registered as a company in the Netherlands. PaardPlaats connects individuals and businesses interested in horses, ponies, equestrian services, and related advertisements.

1. Definitions
- Advertisement: A publication created by a User to promote a horse, pony, service, or product for a limited time.
- Advertiser: A User or Visitor who posts or manages an Advertisement. Advertisers must indicate whether they act in a professional/business capacity or as a private individual.
- General Terms and Conditions: These present Terms and Conditions.
- Rating(s): Feedback provided by Users based on their experience with another User. Reviews may be reported for unlawful or false content and will be assessed.
- Horse Participation Agreement: A contract between a rider/groom and horse owner for shared horse use.
- Content: Any material placed on the platform by PaardPlaats or a User, including text, videos, photos, and advertisements.
- Third Parties: Any entity other than PaardPlaats and its Users.
- Service: The facilitation by PaardPlaats of a Platform to connect Users and Visitors.
- Services: Equestrian-related services offered via the Platform, including but not limited to riding, grooming, and leasing.
- Owner: The legal owner of a horse or pony listed on PaardPlaats.
- User: A registered person with a profile on PaardPlaats.
- Visitor: An unregistered person who accesses the Platform and may contact Advertisers.
- Platform: The PaardPlaats website and associated services.
- Profile: The public-facing page created by a User.
- Verified User: A User whose email address has been verified by PaardPlaats.
- Intellectual Property Rights: All copyrights, trademarks, database rights, and other IP rights.
- Trainer: Any User who offers, publishes or performs Training Services via the Platform, including independent trainers, riding instructors, coaches, clinicians, behaviour specialists, riding schools, equestrian centres, stables and their staff, assistants and substitutes.
- Rider: Any User, Visitor or participant who requests, books, attends or benefits from Training Services, including students, pupils, horse owners, parents or guardians booking on behalf of a minor, and any person they bring to a Session.
- Training Service: Any equestrian training, lesson, coaching, schooling, groundwork, backing, behaviour consultation, clinic, camp, course, online video feedback or similar service offered or booked via the Platform, whether paid, discounted, free, one-off or recurring.
- Booking: A request, reservation or confirmation of a Training Service registered through the Platform between a Rider and a Trainer.
- Session: A single occasion on which a Training Service is performed, including the arrival, preparation, warming-up, cooling-down and departure connected with it.
- Facility: Any stable, yard, arena, indoor or outdoor school, paddock, terrain, cross-country course, horse walker, lorry, trailer or other location or equipment used in connection with a Session.
2. Applicability
2.1 These Terms apply to all use of the Platform by Users and Visitors.
2.2 PaardPlaats may revise these Terms at any time. Updated versions will be published on the Platform. Continued use of the Platform signifies acceptance of the new Terms.
3. Role of PaardPlaats
3.1 PaardPlaats solely provides a Platform that connects Advertisers (Users and Visitors) with interested parties. PaardPlaats is not a party to any agreement or transaction made between parties using the Platform.
3.2 PaardPlaats does not vet the truthfulness, quality, legality, or ownership of the horses, services, or content offered.
3.3 PaardPlaats is not responsible for:
- any transactions made between Users and/or Visitors;
- fraud, misrepresentation, or contractual breaches;
- any injury, loss, or death involving horses or services;
- the accuracy or legality of advertisements;
- any agreements made directly between parties.
3.4 All Users and Visitors use the Platform at their own risk.
4. Registration and Profiles
4.1 Users must be at least 16 years old. Users under 18 require verifiable consent from a legal guardian.
4.2 Users must provide accurate and truthful information in their profiles and are responsible for safeguarding their login credentials.
4.3 PaardPlaats may suspend or delete a profile at its discretion, including in cases of impersonation or breach of Terms.
4.4 It is not permitted to include external URLs in profiles, except where required in Advertisements and optional social links on profile.
5. Advertisements
5.1 Advertisements must pertain to horse/pony related services, products, or animals.
5.2 Advertisers must:
- have ownership or decision-making rights over the offered product or service;
- ensure the availability of the advertised item or service;
- respond to inquiries within a reasonable time;
- post only one product or service per Advertisement;
- avoid misleading, inappropriate, infringing, or illegal content;
- if acting in a professional/business capacity, provide legally required business information including business name, registered address, Chamber of Commerce/KvK number, VAT number (if applicable), and professional contact details. This information will be displayed to buyers as required by EU law.
5.3 By placing an Advertisement, you consent to worldwide publication of your provided contact details (email, phone, postcode, optional WhatsApp/stable name, profile image). PaardPlaats cannot prevent third parties from copying or reusing this data.
5.4 PaardPlaats may remove any Advertisement that breaches these conditions or is reported as illegal/unlawful. Illegal content can be reported via the contact form or email to support@paardplaats.nl. PaardPlaats performs random and regular content checks.
5.5 Visitors may contact Advertisers directly through tools provided by the Platform. Such interactions are entirely at their own risk.
5A. Lease and Rental Horses
5A.1 PaardPlaats may display Advertisements for horse leases, rentals, share arrangements, trial rides, care arrangements, or similar temporary-use arrangements involving a horse or pony (collectively, "Lease Arrangements").
5A.2 PaardPlaats only provides advertising and communication tools. PaardPlaats is not the owner, lessor, lessee, renter, riding school, stable operator, transport provider, insurer, broker, agent, employer, or contracting party in any Lease Arrangement.
5A.3 PaardPlaats does not verify and does not warrant:
- the identity, age, legal capacity, authority, ownership, or right of any person to offer the horse or the Lease Arrangement;
- the temperament, behavior, training, suitability, soundness, health, defects, infectious status, passport or microchip status, vaccinations, insurance, permits, or legal compliance of the horse, facilities, or services;
- the accuracy, completeness, or legality of Advertisements, photos, videos, prices, availability, equipment, transport, or statements made by any party.
5A.4 All checks, inspections, and risk assessments remain the sole responsibility of the parties. Before entering into or performing a Lease Arrangement, the parties must independently assess and, where appropriate, record in writing:
- payment, deposit, duration, trial period, cancellation, termination, refund, and notice arrangements;
- responsibility for supervision, instruction, transport, tack, equipment, stable rules, veterinary treatment, emergency decisions, feed, farriery, boarding, insurance, and third-party damage;
- rider experience, medical fitness, protective equipment, parental consent, and any restrictions on trail riding, competitions, jumping, breeding, sub-leasing, or use by third parties.
5A.5 To the fullest extent permitted by applicable law, PaardPlaats is not liable for any direct or indirect loss, damage, cost, claim, injury, illness, theft, escape, property damage, disability, or death arising from or related to any Lease Arrangement or any visit, trial, ride, lesson, handling session, transport, boarding, or other offline interaction involving the parties or the horse.
5A.6 This includes disputes or losses relating to payments, deposits, no-shows, cancellations, refunds, fraud, misrepresentation, non-disclosure, breach of contract, defects, unsuitability, lack of supervision, equipment failure, road incidents, biosecurity incidents, veterinary emergencies, injury, or death of any person or horse.
5A.7 Each party participates entirely at its own risk and is solely responsible for obtaining appropriate insurance, legal advice, safety equipment, expert guidance, and contractual protection.
5A.8 Nothing in this section excludes or limits any liability of PaardPlaats that cannot be excluded or limited under mandatory applicable law.
5B. Training Services: Role of PaardPlaats
5B.1 PaardPlaats operates an online marketplace, discovery, communication and booking system through which Riders can find Trainers and request, schedule and administer Training Services. PaardPlaats does not itself provide, organise, host, supervise, teach or perform any Training Service or any other equestrian activity.
5B.2 Every agreement concerning a Training Service is concluded exclusively between the Rider and the Trainer. PaardPlaats is never a party to that agreement, not even where the request, acceptance, scheduling, reminders, intake questions, price display, cancellation policy or messages are generated or transmitted through the Platform.
5B.3 Trainers are independent professionals or businesses. Nothing on the Platform creates an employment relationship, agency, partnership, joint venture, franchise or representation between PaardPlaats and a Trainer or a Rider, and no User may present themselves as an employee, agent, representative, branch or partner of PaardPlaats.
5B.4 PaardPlaats does not select, appoint, instruct, supervise, examine, license, certify, accredit, employ or control Trainers. PaardPlaats does not determine the content, method, level, duration, intensity, location, safety or quality of any Session, and does not set or negotiate prices, travel fees, cancellation terms or any other condition agreed between a Rider and a Trainer.
5B.5 PaardPlaats does not verify and does not guarantee: the identity, qualifications, diplomas, certificates, licences, memberships, experience, competence or teaching ability of a Trainer; the existence, scope or validity of any insurance, registration, permit or tax status; the suitability, temperament, health, soundness, level or ownership of any horse; the safety, condition, legality or insurance of any Facility, equipment or transport; or the accuracy of any description, photo, video, price, availability or review published by a User.
5B.6 Any badge, label, ranking, “verified” mark, rating, level, score, featured placement or search order shown on the Platform is an administrative or algorithmic indication only. It is not an endorsement, recommendation, certification, warranty or statement by PaardPlaats about the suitability, competence, safety or solvency of a Trainer or a Rider. Each User must make their own assessment before booking or accepting a Booking.
5B.7 PaardPlaats does not attend, supervise, monitor or record Sessions and has no knowledge of, control over or responsibility for anything that occurs before, during or after a Session, including at the meeting point, on the way to or from a Session, at a Facility, in the arena or stable, during loading or transport, or in any contact or arrangement between Users outside the Platform.
5B.8 All use of the Platform, and all contact, agreement, visit, trial, transport, training and payment arising from it, takes place at the Users’ own risk and under their own responsibility.
5B.9 PaardPlaats gives no veterinary, medical, farriery, nutritional, physiotherapeutic, insurance, tax, employment or legal advice. Articles, checklists, intake questions, suggested prices, templates, progress indicators and other information on the Platform are general information only and are never professional advice for a specific horse, Rider or situation.
5C. Obligations of Trainers, Riding Schools and Stables
5C.1 A Trainer may only publish a trainer profile and offer Training Services if the Trainer is at least 18 years old, is legally competent, and is entitled to provide the services offered in the country where they are performed.
5C.2 The Trainer is solely responsible for obtaining and maintaining, at their own cost, all qualifications, diplomas, certifications, licences, permits, registrations (including, where applicable, registration with the Dutch Chamber of Commerce (KvK) or an equivalent register) and memberships required for the services offered, and for complying with all applicable professional, safety, animal welfare, environmental, planning, employment and tax law.
5C.3 The Trainer must hold adequate and valid liability insurance covering their professional activities (in the Netherlands typically a bedrijfsaansprakelijkheidsverzekering, and where relevant cover for riding, handling, keeping or transporting horses belonging to third parties) for the entire period during which Training Services are offered or performed, and must provide evidence of that cover to a Rider on request. PaardPlaats provides no insurance of any kind and is not a party to any insurance contract.
5C.4 The Trainer is exclusively responsible for the tax, social security, VAT, invoicing and accounting consequences of their activities, including the correct declaration and payment of all amounts due on income received from Riders. PaardPlaats does not withhold, declare, invoice or remit any tax or contribution on behalf of a Trainer.
5C.5 Where PaardPlaats is required by law — including under Council Directive (EU) 2021/514 (DAC7) and its national implementation — to collect, verify or report information about Trainers or their activities to a tax or supervisory authority, the Trainer will provide the requested information promptly and accurately, and accepts that PaardPlaats may restrict or suspend the profile until it is provided.
5C.6 The Trainer warrants that all information published, including qualifications, disciplines, levels, experience, insurance status, prices, travel fees, availability, location, languages, photos and videos, is accurate, current, not misleading and lawful, and that the Trainer holds all rights necessary to publish the content uploaded.
5C.7 The Trainer must perform every Session with the care, skill and diligence of a competent professional, must assess whether the exercise, level and intensity are suitable for the horse and the Rider concerned, must safeguard the physical and mental welfare of every horse in accordance with applicable law (including the Dutch Wet dieren and Besluit houders van dieren), and must adapt, interrupt, refuse or end a Session where safety or welfare so requires.
5C.8 The Trainer is responsible for the safety of the Session, including assessment of the terrain, footing, arena, obstacles, materials, weather, traffic and surroundings, the use of appropriate protective equipment, the availability of first-aid provisions and an emergency procedure, and the instructions given to the Rider and to any assistant, groom, parent or bystander present.
5C.9 The Trainer must maintain their own terms and cancellation policy governing the relationship with the Rider, must communicate them and any material circumstance affecting the Session (such as a change of location, a change of instructor, the identity and suitability of a school horse provided, or Facility rules) before the Session, and remains fully responsible for their content and enforcement. Cancellation options shown on the Platform are a technical display of the Trainer’s own policy and never become terms of PaardPlaats.
5C.10 The Trainer may not:
- present PaardPlaats as a party to, guarantor of, or participant in the training relationship;
- offer or perform services which are unlawful or unsafe, or which the Trainer is not qualified, insured or permitted to provide;
- provide veterinary treatment, medication, diagnosis, dentistry, farriery or physiotherapy unless lawfully qualified and permitted to do so;
- apply training methods, equipment or workloads that cause avoidable pain, fear, injury, exhaustion or distress to a horse;
- transfer, sell, share, rent or sublicense a trainer profile or account, or publish services on behalf of an undisclosed third party.
5C.11 If a Trainer works with employees, assistants, apprentices, substitutes or subcontractors, the Trainer remains fully responsible towards the Rider and towards PaardPlaats for their acts and omissions, and must ensure that any substitution is communicated to and accepted by the Rider in advance.
5C.12 Where the Trainer uses the Platform as a business user within the meaning of Regulation (EU) 2019/1150, PaardPlaats will state the grounds for any restriction, suspension or termination of access and observe the notice periods prescribed by that Regulation, and makes an internal complaint-handling procedure available via support@paardplaats.nl. This does not affect the right of PaardPlaats to act with immediate effect where required by law or in cases of fraud, abuse, repeated infringement, or a serious risk to persons or animals.
5D. Obligations of Riders, Students and Clients
5D.1 Before booking, the Rider is responsible for assessing whether a Trainer, discipline, level, exercise, Facility and horse are suitable and safe for their own situation, and for verifying the Trainer’s qualifications, experience and insurance directly with the Trainer.
5D.2 The Rider warrants that they are in sufficient physical and mental health and condition to take part, that they participate voluntarily, and that they are not under the influence of alcohol, medication or drugs affecting their ability to ride or handle a horse safely.
5D.3 The Rider must inform the Trainer before the Session of any relevant medical condition, injury, disability, allergy, pregnancy, medication or limitation affecting themselves or any participant they register, and of any relevant behaviour, health issue, injury, lameness, infection risk, vaccination status or training history of the horse involved.
5D.4 The Rider is responsible for wearing and using appropriate, well-fitting and undamaged safety equipment, including a helmet meeting the applicable safety standard and, where appropriate, a body protector and suitable footwear, and for the suitability, fit, condition and safety of their own tack, harness and equipment.
5D.5 The Rider must follow the reasonable instructions of the Trainer and the rules of the Facility at all times, and must immediately report anything they experience as unsafe, painful or beyond their ability. The Rider decides for themselves whether to carry out an exercise and may refuse or stop at any time.
5D.6 The Rider warrants that any horse they present is fit, healthy, sufficiently trained and insured for the Training Service booked, is free of contagious disease and vaccinated in accordance with applicable rules, and that the Rider owns the horse or is authorised by the owner to present it for training and to allow it to be ridden, handled, lunged or transported by the Trainer.
5D.7 The Rider remains responsible for their horse before, during and after the Session, including its care, handling, transport, welfare and behaviour, and for damage caused by that horse to persons, animals or property, subject to article 5F.
5D.8 The Rider is responsible for arranging their own insurance, including personal liability insurance (in the Netherlands typically an aansprakelijkheidsverzekering particulieren), accident insurance and, where relevant, horse, equipment and transport insurance. PaardPlaats provides no insurance cover to Riders.
5D.9 The Rider is responsible for the supervision, behaviour and safety of any person or animal they bring to a Session, including children, family members, grooms and spectators, and for compliance with the Facility’s house rules by those persons.
5E. Training Bookings, Prices, Payments and Cancellations
5E.1 A Booking request submitted through the Platform is an offer by the Rider to enter into an agreement with the Trainer. The agreement is concluded between Rider and Trainer when the Trainer accepts the request. PaardPlaats does not accept, confirm, guarantee or underwrite any Booking on behalf of a Trainer.
5E.2 Prices, travel fees, session lengths, packages, discounts, deposits, cancellation terms and no-show charges are determined solely by the Trainer. PaardPlaats displays them as supplied by the Trainer, does not verify them, and does not act as price setter, guarantor or intermediary in respect of them.
5E.3 Unless the Platform expressly states otherwise at the moment of booking, payment for Training Services takes place directly between the Rider and the Trainer, outside the Platform. PaardPlaats does not collect, hold, escrow, process, guarantee, refund or invoice payments for Training Services, is not a payment service provider or collection agent for the Trainer, and has no obligation or ability to intervene in any payment, non-payment, deposit, cash arrangement, discount, chargeback, invoice, receipt or tax document between the parties.
5E.4 If PaardPlaats offers online payment for Training Services in the future, it will do so through a licensed payment service provider and publish the applicable additional conditions in advance. Even then, PaardPlaats acts solely as a technical facilitator and, where expressly indicated, as collection agent for the Trainer, and does not become a party to the agreement between Rider and Trainer.
5E.5 Cancellations, rescheduling, refunds, credits, partial payments and no-show charges are governed exclusively by the terms agreed between Rider and Trainer. A status displayed on the Platform (such as “cancelled” or “free cancellation until”) is an administrative record only and creates no right, obligation, payment guarantee or liability on the part of PaardPlaats.
5E.6 PaardPlaats does not guarantee that a Trainer will accept, attend, perform or complete a Booking, that a Session will take place at the agreed time, place, level or duration, that a school horse or Facility will be available, or that any result, progress, competition outcome, qualification or improvement will be achieved.
5E.7 PaardPlaats may refuse, hide, reschedule, suspend or cancel Bookings, profiles, services, media or messages where there is a suspicion of fraud, abuse, unlawful conduct, unsafe practice, animal welfare risk or breach of these Terms, without being liable for any loss resulting from such a measure.
5E.8 Where the Rider is a consumer and books a Training Service, clinic, camp or similar leisure service for a specific date or period, the statutory right of withdrawal does not apply (Article 6:230p(e) of the Dutch Civil Code, implementing Article 16(l) of Directive 2011/83/EU). Rights the consumer has towards the Trainer under mandatory consumer law are unaffected.
5E.9 Riders and Trainers remain free to contract directly outside the Platform. Where they do, the Platform’s Booking record, cancellation display, messaging, reminders and reporting functions do not apply, and PaardPlaats has no involvement, information or responsibility of any kind in respect of that agreement. Users may not, however, use the Platform to circumvent applicable fees, safety rules or reporting obligations.
5E.10 Messaging, reminders, calendars, availability, intake forms and other tools are provided as an administrative convenience on an “as is” basis. PaardPlaats does not guarantee their availability, accuracy, timeliness or delivery, and the parties remain responsible for confirming arrangements directly with each other.
5F. Assumption of Risk, Safety and Limitation of Liability for Training
5F.1 Riding, driving, handling, training, lunging, loading, transporting and being in the vicinity of horses are inherently dangerous activities. Horses are large animals that may act unpredictably, may take fright, bite, kick, bolt, buck, rear, fall or step on a person, and may cause serious injury, permanent disability, death or damage to property even when every reasonable precaution has been taken.
5F.2 Every Rider and participant accepts these inherent risks voluntarily and participates entirely at their own risk, on the basis of their own assessment of those risks and of the Trainer, horse and Facility concerned.
5F.3 PaardPlaats is not liable for any personal injury, illness, psychological harm or death, or for loss of or damage to horses, equipment, vehicles, buildings, Facilities or other property, however caused, arising out of or in connection with a Training Service, a Trainer, a Rider, a horse, a Facility or any arrangement made via the Platform, including where the damage occurs before, during or after a Session, at a meeting point, during transport, at a stable or arena, or during a trial, viewing, free or unpaid session.
5F.4 Without limitation, PaardPlaats is not liable for:
- acts, omissions, negligence, incompetence, misconduct, fraud, insolvency or non-performance of a Trainer, Rider, Facility, employee, assistant, substitute or other User;
- unsuitable, unsafe or harmful training methods, exercises, equipment or instructions;
- the condition, behaviour, health, welfare, injury, illness, escape, disappearance or death of a horse;
- the condition, safety, legality or insurance of a stable, arena, terrain, obstacle, footing, fencing, equipment or means of transport;
- accidents involving third parties, other horses, animals, vehicles or bystanders;
- amounts that are unpaid, disputed, refunded, charged back or cancelled between Users;
- any statement, description, review, rating, badge, ranking, availability or intake questionnaire published on the Platform;
- infectious disease transmitted between horses or persons in connection with a Session;
- theft, vandalism, damage or loss of property at or around a Session;
- any decision by a Rider or owner to have a horse ridden, handled, transported, stabled or treated by a Trainer or third party.
5F.5 Liability of the possessor of an animal under Article 6:179 of the Dutch Civil Code, and liability of the professional user of an animal under Article 6:181 of the Dutch Civil Code, rests with the owner, possessor or professional user of the horse concerned, and never with PaardPlaats, which at no time keeps, uses, controls, houses, transports or supervises a horse.
5F.6 Where, notwithstanding the foregoing, any liability of PaardPlaats in connection with Training Services is nevertheless established, that liability is limited per event or series of connected events to the total amount the User concerned paid to PaardPlaats for Platform services in the twelve (12) months preceding the event, with an absolute maximum of €1,000. Consequential loss, loss of income, clients, profit, opportunity or data, reputational harm, veterinary and medical costs, costs of a replacement horse, trainer or Facility, and immaterial damage are excluded in all cases.
5F.7 Any claim against PaardPlaats lapses if it is not notified in writing, with substantiation, within thirty (30) days after the User discovered or reasonably should have discovered the damage, and in any event twelve (12) months after the event giving rise to it.
5F.8 Riders and Trainers indemnify PaardPlaats and hold it harmless against all claims, actions, proceedings, fines, damages, costs and expenses (including reasonable legal costs) of third parties — including other Users, participants, horse owners, Facility owners, insurers, heirs, professional bodies and authorities — arising out of or in connection with the Training Services they offer, book, perform or attend, their use of the Platform, the content they publish, or their breach of these Terms or of applicable law.
5F.9 Nothing in this article excludes or limits liability that cannot lawfully be excluded or limited, including liability for damage caused by intent or deliberate recklessness (opzet of bewuste roekeloosheid) on the part of PaardPlaats or its management, liability for death or personal injury caused by PaardPlaats itself, and mandatory rights of consumers. If a provision of this article is wholly or partly void, voidable or unenforceable, it will be converted into, or read as, a valid provision that approximates its purpose and effect as closely as possible, and the remaining provisions remain in full force.
5G. Horses, Stables, Facilities and Transport
5G.1 The location where a Session takes place is chosen by the Rider and the Trainer. PaardPlaats does not own, rent, inspect, approve, insure or control any Facility used in connection with a Session.
5G.2 The party providing the location is responsible for its safety, condition, maintenance, lighting, footing, fencing, obstacles, equipment, fire safety, emergency access, permits, house rules and insurance, and for damage caused at or by that location.
5G.3 Where a Session takes place at a third-party location, the Rider and the Trainer are each responsible for having the necessary permission to be present and to train there, for observing that location’s rules and any additional conditions or charges it imposes, and for damage caused to that location, its horses, staff or visitors.
5G.4 Where a Trainer travels to the Rider, the Rider is responsible for the suitability and safety of the location made available, including footing, obstacles, fencing, loose animals, traffic and bystanders, and for lawful access to it.
5G.5 Transport of horses is at the risk and responsibility of the party arranging it, which is responsible for the roadworthiness, licensing, loading, securing, insurance and legal compliance of the transport and for the welfare of the horse during it. PaardPlaats arranges no transport and is not liable for any incident connected with it.
5G.6 Where a Trainer provides a school horse or other horse for a Session, the Trainer is responsible for its suitability, health, tack, behaviour and insurance, and for informing the Rider of any limitation or risk relating to it.
5G.7 In the event of an accident, injury, illness or emergency involving a person or a horse, the parties present are responsible for taking appropriate action, calling emergency or veterinary assistance and bearing the resulting costs. PaardPlaats has no role in and no liability for such decisions or costs and reimburses no veterinary, medical, transport, funeral or emergency expenses.
5G.8 The Rider and the Trainer are responsible for compliance with biosecurity, quarantine, vaccination, movement, passport, chip and identification requirements applicable to the horses involved.
5H. Clinics, Camps, Group Training and Online Coaching
5H.1 For clinics, camps, group lessons, courses and comparable events, the organising Trainer is solely responsible for the organisation, capacity, supervision, group composition, level assessment, insurance, permits, safety, catering, accommodation, stabling and cancellation of the event, and for compliance with any package travel rules that may apply where accommodation or transport is included.
5H.2 PaardPlaats does not organise, co-organise, host, sell tickets for or guarantee any event, and is not liable for cancellation, postponement, relocation, overbooking, weather, the absence or substitution of an instructor, or the conduct or safety of any participant, horse or spectator.
5H.3 For online coaching and video feedback, the Trainer’s assessment is necessarily limited to the material submitted. It is not a diagnosis and does not replace hands-on instruction, veterinary examination or supervision on site. The Rider decides whether, when and how to apply any advice and must not attempt exercises they cannot perform safely without supervision.
5H.4 Users are responsible for the content, lawfulness and rights of any video, photograph, audio recording or document they upload, and for the privacy of every person appearing in it. Where a recording is made at a Facility or event, the person recording is responsible for obtaining the necessary consent and permission.
5H.5 Trainers and Riders may not record, publish, share or use Sessions, messages, intake information, health data or other personal data of the other party for any purpose other than performance of the agreement between them, without that party’s consent.
5H.6 Training plans, programmes, exercises, videos and written feedback supplied by a Trainer are personal to the Rider and horse concerned and may not be redistributed, resold or published without the Trainer’s consent. PaardPlaats does not assess the correctness, suitability or safety of such material.
5I. Minors, Safeguarding and Vulnerable Participants
5I.1 Participants under the age of 18 may only be registered for and take part in a Training Service with the consent of a parent or legal guardian, who accepts these Terms on their behalf and remains responsible for the minor’s participation, supervision, safety equipment and behaviour.
5I.2 The parent or legal guardian is responsible for informing the Trainer of the minor’s age, level, health and any special needs, and for deciding whether the minor may attend a Session unaccompanied; that decision is a matter between the guardian and the Trainer only.
5I.3 PaardPlaats performs no background checks, criminal record checks or screening of Trainers (such as a Dutch Verklaring Omtrent het Gedrag) and gives no assurance regarding the suitability of any Trainer to work with minors or vulnerable persons. Trainers working with minors or vulnerable persons must comply with all applicable safeguarding requirements and are responsible for obtaining and maintaining any declaration, screening or certification required.
5I.4 Any suspicion of abuse, unsafe conduct, animal cruelty or a criminal offence must be reported to the competent authorities. Reports may also be made to PaardPlaats via the contact form or support@paardplaats.nl, after which PaardPlaats may — but is not obliged to — remove content, suspend accounts or share information with authorities in accordance with applicable law.
5J. Verification, Reviews, Rewards, Data and Disputes
5J.1 A “verified” indication for a Trainer means only that certain administrative details submitted to PaardPlaats were checked to a limited extent at a particular moment. It is not a certification of competence, safety, insurance or quality, and PaardPlaats may add, amend or withdraw such an indication at any time.
5J.2 Reviews and ratings reflect the personal opinion of individual Users. PaardPlaats does not verify their accuracy, is not responsible for their content and does not guarantee that every Session or Trainer has been reviewed. Article 8 applies in full to training reviews.
5J.3 Levels, experience points, streaks, badges, rewards and comparable features have no monetary value, cannot be exchanged, transferred or paid out, confer no rights, and may be amended, recalculated, suspended or discontinued at any time. They are administrative indications of activity and may never be a reason to train a horse or Rider beyond a safe and healthy level; welfare and safety always prevail.
5J.4 Intake information about a Rider (including any health information) and about a horse is supplied by the Rider for the purpose of the Training Service and shared with the Trainer concerned. In respect of the personal data it receives, the Trainer is an independent controller and must process that data lawfully, confidentially and solely for the training relationship, in accordance with the GDPR. PaardPlaats processes personal data as described in its Privacy Policy.
5J.5 PaardPlaats may moderate, edit, refuse, suspend or remove profiles, services, reviews, media, messages and Bookings, and may suspend or terminate access, in accordance with these Terms and without being liable for loss resulting from such measures.
5J.6 Disputes between a Rider and a Trainer must be resolved between them. PaardPlaats is not an arbitrator, mediator, ombudsman, guarantor or insurer, is under no obligation to intervene, investigate, mediate or compensate, and any assistance it does provide is voluntary, without acknowledgement of liability and without any obligation to continue it.
5J.7 These provisions are published in several languages. In the event of any discrepancy between language versions, the Dutch version prevails, without prejudice to mandatory rights of consumers in their own language and country of residence.
6. Advertisement Fees and Billing
6.1 Each Advertisement is published free of charge for an initial period of one (1) month.
6.2 If the Advertisement remains active after this free period, a paid advertising period of three (3) months will start automatically.
6.3 The total price for this three-month paid period is EUR 9.99 in total, including VAT where applicable. This is a one-time amount and not a monthly fee.
6.4 After the free one-month period ends, PaardPlaats will automatically charge this one-time amount of EUR 9.99 once through the payment method selected by the Advertiser.
6.5 PaardPlaats will send the Advertiser a reminder by email three (3) days before the automatic payment is processed.
6.6 The Advertiser can prevent the charge by removing the Advertisement, deactivating it, or marking it as sold before the end of the free one-month period.
6.7 After the three-month paid period ends, no recurring charges will apply and the Advertisement will not be renewed automatically. Any further paid placement requires a new and separate action by the Advertiser.
6.8 By placing an Advertisement on the Platform, the Advertiser expressly agrees to and authorizes the above one-time automatic charge after expiry of the free one-month period, provided the Advertisement has not been removed, deactivated, or marked as sold in time.
6A. Membership Fees, Trial Period and Automatic Billing
6A.1 Memberships include a free trial period of fourteen (14) days starting on the activation date of the selected membership tier. No charges apply during the trial period.
6A.2 If the user cancels the membership before the end of the fourteen (14)-day trial period, no membership fee will be charged.
6A.3 If the user does not cancel before the trial period ends, the membership automatically converts into a paid monthly subscription for the selected membership tier.
6A.4 The applicable monthly membership fee depends on the membership tier selected by the user and is shown clearly before the membership is started.
6A.5 The first payment is charged immediately after the fourteen (14)-day trial period ends. That payment relates to the first billing cycle linked to the original activation date, meaning that the first cycle also includes the trial period.
6A.6 After the first payment, the membership fee will be charged automatically each month using the payment method selected by the user. Each subsequent payment is charged on the same calendar day of the month as the original membership activation date or, if that calendar day does not occur in a given month, on the last day of that month.
6A.7 By starting a membership, the user expressly requests and authorizes the automatic conversion to a paid subscription after the trial period and explicitly agrees to the recurring monthly charges that follow unless the membership is cancelled before the trial period ends.
7. Platform Use
7.1 Users and Visitors agree to use the Platform respectfully and legally.
7.2 It is prohibited to:
- post discriminatory, unlawful, or offensive content;
- harass, defraud, or impersonate others;
- upload viruses or malware;
- disrupt the functionality of the Platform.
8. Reviews and Ratings
8.1 Users may write reviews and rate each other only where a real interaction (transaction, communication, or service) has taken place.
8.2 Reviews must be honest, lawful, and relevant. Defamatory, irrelevant, or fake reviews are prohibited.
8.3 PaardPlaats does not guarantee the authenticity of reviews but will take reasonable steps to detect and remove manifestly false or unlawful reviews.
8.4 Reviews can be reported via the contact form or email to support@paardplaats.nl. Reported reviews will be assessed and may be removed.
8.5 Users may appeal a review removal or decision within 14 days by contacting support@paardplaats.nl. Appeals will be reviewed fairly and impartially.
9. Intellectual Property
9.1 All Platform content and design are the property of PaardPlaats or its licensors.
9.2 Users grant PaardPlaats a non-exclusive, royalty-free, worldwide license to use their posted content for platform operation and promotional purposes, including social media promotion.
9.3 This license terminates when the content is deleted by the User, except where retention is required for legal reasons, backups, or caching beyond PaardPlaats' immediate control.
9.4 Users confirm they have the rights to any content they upload.
10. Liability
10.1 PaardPlaats is not liable for any damages resulting from:
- use of or reliance on the Platform;
- errors in Advertisements;
- misrepresentation, fraud, or non-performance by Users or Visitors;
- third-party actions;
- downtime, errors, or loss of access.
10.2 Maximum liability of PaardPlaats, where not otherwise excluded, is limited to €1,000 per incident.
10.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, gross negligence, or any liability that cannot be excluded under mandatory law.
11. Termination
11.1 Users may cancel their account at any time.
11.2 PaardPlaats may terminate or restrict access for any reason without liability, including for breaches of these Terms.
12. Privacy
12.1 Personal data is processed in accordance with Dutch and EU data protection laws and PaardPlaats' Privacy Policy.
13. Digital Services Act (DSA) Compliance
13.1 PaardPlaats complies with the EU Digital Services Act. Illegal content may be reported via the contact form or email support@paardplaats.nl.
13.2 Reported content will be reviewed promptly, and appropriate action will be taken, including removal where necessary.
13.3 Advertisements and listings are ranked primarily by recency, relevance, and any paid promotion. Sponsored listings are clearly identified.
13.4 Advertisers must declare whether they act in a professional/business capacity. PaardPlaats will disclose this information to potential buyers.
13.5 PaardPlaats provides a single point of contact for authorities and users regarding DSA compliance: support@paardplaats.nl.
13.6 Users whose content is removed may appeal within 14 days by contacting support@paardplaats.nl. Complaints will be handled promptly and fairly.
14. Consumer Rights and Dispute Resolution
14.1 If you are a consumer under EU law, you may have certain mandatory rights under consumer protection laws. These Terms do not limit those rights.
14.2 Because advertisements are published immediately after payment, no statutory right of withdrawal applies to paid ads once placed. By submitting payment, you agree to waive the 14-day withdrawal period.
14.3 Complaints can be submitted to support@paardplaats.nl. We aim to resolve complaints within 14 days.

15. Governing Law and Jurisdiction
15.1 These Terms are governed exclusively by Dutch law.
15.2 Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory consumer law states otherwise. If you reside outside the EU/EEA, you are responsible for ensuring compliance with your own local laws when using PaardPlaats. Mandatory consumer protection rights in your country of residence may also apply.
By using the Platform, you agree to these Terms and Conditions. If you do not agree, please refrain from using PaardPlaats.
